1. About These Terms

These Terms of Service ("Terms") govern your use of the QRNFC Global platform ("Service"), operated by Curtisium, registered in Jersey, Channel Islands ("we", "us", "our").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

These Terms are governed by the laws of Jersey, Channel Islands, the European Union General Data Protection Regulation (GDPR), the UK Data Protection Act 2018, and applicable US federal and state laws including the California Consumer Privacy Act (CCPA/CPRA).

2. The Service

QRNFC Global allows you to create QR codes and NFC URLs, upload content (messages, photos, videos, audio), and share that content with anyone who scans the code or taps the NFC URL. Our core promise is "Pay once. Auto-renews free." — content you upload is stored with Year 1 and Year 2 included in the purchase price, then auto-renews free every year at no additional cost, as long as the platform operates.

The Service also includes (depending on your plan tier): real-time scan analytics, retargeting pixels, A/B testing, smart routing, custom domains and white-label playback pages, BYOK storage (Bring Your Own Bucket), team collaboration with audit logging, a public REST API (Bearer-token authenticated, available on Enterprise tier), TV / Screen campaign tooling, and our self-serve Vault download for full data portability.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials.

Age requirements:

  • European Union / UK: You must be at least 16 years of age
  • United States: You must be at least 13 years of age (in compliance with COPPA)
  • All other regions: You must meet the minimum age requirement in your jurisdiction

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Storage Credits & Payments

What is a Storage Credit? A storage & viewing credit is a one-time purchase that activates long-term hosting for the content linked to your QR/NFC item.

Personal Tier (Pay-Per-Code) Pricing:

  • Year 1: Each storage & viewing credit pack includes activation and first-year storage
  • Year 2: A nominal second-year renewal fee is bundled into the one-off purchase price
  • Year 3+: Content auto-renews free every year at no additional charge, as long as the platform remains operational and the code is scanned at least once per year

Business Tier (Monthly Subscriptions): Business plans are billed monthly and include unlimited QR code creation, A/B testing, retargeting pixels, and campaign tools. Subscriptions can be upgraded, downgraded, or cancelled at any time — changes take effect at the start of the next billing cycle.

All purchases are subject to our Refund Policy. You may request a full refund within 14 days of any purchase. Unused storage & viewing credits remain in your account indefinitely.

Prices are displayed in your selected currency (USD, EUR, or GBP). All payments are processed securely through our third-party payment provider. We do not store your payment card information.

4a. Partner Fairness Commitment

Our promise to every partner, reseller, and B2B2C operator on the platform: our direct-to-consumer per-credit pricing will always be at or above the cheapest single-unit price we charge end-buyers through any partner SKU.

Concretely:

  • The cheapest partner-issued upgrade today is $6.99 (Trophy Basic) / £5.99 / €6.49.
  • Our single-code consumer pricing is locked at the same floor as the partner SKU. Bulk packs (11 / 22 / 60 codes) offer progressive volume discounts capped at 21% off — partners selling individual codes will never be undercut on the equivalent unit price.
  • If we ever reduce a partner-floor SKU price, we will lower the single-code consumer floor in lockstep on the same day, never before, and notify partners by email at least 14 days in advance.
  • Our wholesale reseller pricing (a separate, contract-only channel for approved resellers) is governed by a separate per-partner agreement and is not subject to the public consumer floor.

This clause exists so partners can sign onto the QRNFC Global ecosystem with confidence that they will not be undercut on single-code sales by our retail prices. It is verifiable: the single-code consumer price on our public pricing page is locked by automated tests against this floor (see test_no_preset_undercuts_partner_floor in our public test suite).

Effective: 8 February 2026. Reviewed quarterly.

5. Content Ownership & Licence

Your content remains yours. You retain all ownership rights to any content you upload. By uploading content, you grant us a limited, non-exclusive licence to store, process (including compression), and serve your content to anyone who scans the associated QR code or NFC URL.

You are solely responsible for the content you upload. You must have the legal right to share any content you upload.

6. Acceptable Use

You agree not to upload or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Contains child sexual abuse material (CSAM) of any kind
  • Infringes on any third party's intellectual property rights
  • Contains malware, viruses, or harmful code
  • Is fraudulent, deceptive, or misleading
  • Violates any applicable law or regulation in any jurisdiction

We reserve the right to remove any content that violates these Terms and to report illegal content to the relevant authorities. See our DMCA Policy tab for copyright infringement procedures.

Public REST API (Enterprise tier): If you generate API keys (at /account/api-keys) you are responsible for keeping them secret. You agree not to: (a) share keys publicly, (b) bypass published rate limits, (c) use the API to scrape, mirror, or resell data belonging to other QRNFC customers, or (d) use it to attempt unauthorised access. We may revoke keys without notice for breaches. All API actions are logged in your team's audit log.

7. Fair Use Policy

Our Service includes a Fair Use Policy to ensure sustainable service for all users. Each QR code includes generous upload limits and a monthly scan allowance. Reasonable single-file size and duration caps apply to keep playback fast and storage costs sustainable; specific limits are published in your account uploader and may be revised from time to time. If a QR code exceeds its fair-use scan threshold, a small QRNFC Global branding banner will appear on the public page. Your content will continue to play — it is never blocked.

We reserve the right to limit accounts that engage in abusive usage (e.g., automated scans, general-purpose file storage, circumventing limits). For full details, please see our Fair Use Policy tab.

8. Storage Continuity & Dormancy Policy

We commit to storing your activated content with Year 1 and Year 2 included in the purchase price. From Year 3 onward, storage & viewing auto-renews free every year at no additional charge, as long as QRNFC Global continues to operate and the code receives at least one scan per year. There are no recurring storage or viewing fees for content you have already paid to activate. We refer to this commitment publicly as our “Forever Promise” — a branded name for our scan-renewal model. It is not an unconditional lifetime guarantee; the conditions below apply.

Inactivity Reminder (12 months): If a code goes 12 months without a single scan, we send the account owner an email reminder. A single scan of the code resets the timer back to zero.

Archive Tier (24 months): If a code then goes a further 12 months (24 months total) without any scan, we move that album to our archive tier. Public scans of the code return a friendly “archived” page rather than the content. Nothing is deleted: the owner can sign in to their dashboard at any time and click “Bring it back” to instantly restore full public access, free of charge, no questions asked. Archived content remains in our archive tier indefinitely while the account is in good standing.

Vault Download (Data Portability): At any time, you can download a complete ZIP archive of all your media — every photo and video you’ve uploaded, organised by code, with a manifest file and a self-contained offline HTML viewer that works without internet access. Visit your Account or Dashboard and click “Download my Vault”. This is in addition to your statutory data-portability rights under GDPR Art. 20 / CCPA.

Public “Keep a copy”: For tags whose owner has enabled it (or where the template type is a memorial, wedding, gift, or similar emotionally permanent use case), the public viewer of the QR code can download a small ZIP of the tag’s content. This is opt-in for paying Business customers and on by default for emotional templates on Personal accounts.

Lifeboat Backup (per album, one click): Owners of album-style codes can download a Lifeboat backup — a single ZIP containing every photo, video, and audio entry, plus a self-contained index.html viewer that works offline in any browser, with no internet, no JavaScript, and no dependency on QRNFC. Even if our servers, Cloudflare R2, or any third party disappears, the unzipped folder still opens and plays. Visit the album page and click “Lifeboat backup”. This is included free with every album code, with no per-export charge.

Service Wind-Down: In the unlikely event that QRNFC Global ceases operations, we will provide a minimum of 90 days’ notice during which all users may download their content and Vault at no charge. This ensures your content remains accessible and portable regardless of circumstances.

9. Account Deletion & Data Rights

You may request deletion of your account and associated data at any time by contacting privacy@qrnfcglobal.com. Upon account deletion:

  • Your personal data will be removed within 30 days
  • All associated QR code content will be permanently deleted
  • Payment records will be retained for 7 years as required by financial regulations

10. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We are not liable for any losses resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Curtisium shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Dispute Resolution

EU/UK Users: Disputes are governed by the laws of Jersey, Channel Islands, subject to the exclusive jurisdiction of the courts of Jersey. You also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

US Users: Disputes are subject to binding arbitration under the rules of the American Arbitration Association (AAA). You agree to waive the right to participate in class action lawsuits to the maximum extent permitted by law.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email with at least 30 days' notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
